Justice Kasher recuses himself
Tuesday, November 4, 2025, 9:24 Earlier this week, Attorney Yosef Ben Baruch petitioned the High Court of Justice on behalf of Honenu and the Choose Life Forum of bereaved families. The petition asks the court to order the Attorney General to confiscate the Chief Military Advocate’s cell phone and conduct a thorough investigation of her involvement in the Sde Teiman case. The petition was filed hours before the Chief Military Advocate “disappeared.” Supreme Court Justice Yechiel Kasher asked to postpone ruling on the petition, without citing that he had worked with the Attorney General in a law firm. Several hours later, the Chief Military Advocate was located at a beach, without her cell phone. In light of the publication of the postponement, this morning (Tuesday), Justice Kasher announced that he would recuse himself from ruling on the petition.
Attorney Ben Baruch stated, “This is an instance of one hand washing the other. We petitioned the court to order the immediate confiscation of the Chief Military Advocate’s cell phone, and we filed it well before she disappeared and attempted to destroy her phone. Investigators could have used the phone to implicate other officials involved in the case. Unfortunately, the court denied an unequivocally justified request in real time, thereby allowing the Chief Military Advocate to attempt to destroy her phone, one of the most important pieces of completely objective evidence in the case.”
