Sunday, July 9, 2023, 16:04 Today (Sunday), the Jerusalem Magistrates Court released a resident of Yehuda and Shomron who was detained after the terror attack in Eli. Four days previously, a gag order imposed on the case was lifted and the resident’s shocking remand conditions were revealed.
He was held for approximately two weeks by the GSS under harsh conditions, including solitary confinement in a small, cell, exposure to bright lighting 24 hours a day, and alternating freezing and sweltering temperatures in the cell, from which he suffered greatly.
At the hearing, a statement of claim was filed against the resident and the police requested a five-day remand extension. Judge Amir Shaked rejected the request and conditionally released the resident. A stay of execution was issued for the decision, and the State Attorney’s Office announced that they would appeal the decision to the Jerusalem District Court.
Honenu Attorney Nati Rom, who is representing the resident, stated, “The Jewish Department of the GSS and the Department of Nationalist Crime in the Central Unit of the Yehuda and Shomron Police are again showing contempt for the court. They refuse to accept court decisions and have not allowed my client phone calls or personal items despite a court ruling. Today, in court, it turned out that contrary to the claim by the GSS and the Yehuda and Shomron Police, there are no grounds to suspect my client of setting fires or throwing rocks. The court did well to release my client. I am not acquainted with a precedent for the GSS interrogating and violating the fundamental rights of a detainee suspected only of property crimes, as serious as they may be.”
Also today, a statement of claim and a request for remand extension were filed against the soldier who was detained after the Eli terror attack. The Jerusalem Magistrates Court released the soldier on Thursday. However, the District Court accepted an appeal from the State Attorney’s Office and extended his remand until today. The hearing is still in progress. Honenu Attorney David HaLevi will demand the soldier’s release.
