DM Gallant persists with administrative orders

Sunday, September 29, 2024, 16:06 Defense Minister Yoav Gallant signed four-month administrative detention orders against two Shomron residents, one of whom is married and has a small daughter. Both of the residents were detained last week by the Yehuda and Shomron Police. The orders were served shortly before a court hearing at which they were expected to be released from remand. Minister Gallant’s newest orders bring the total of orders against Yehuda and Shomron residents to a total of 28 orders issued to Jews that he has signed since he took office two years ago, more than any other defense minister. Honenu Attorneys Daniel Shimshilashvili and Moshe Poleski are representing the detainees.

Attorney Shimshilashvili leveled sharp criticism at Minister Gallant: “At a time when the security forces are demonstrating an exceptional ability to destroy the enemy, one would expect the Defense Minister to understand that the genuine enemies of Israel are arch terrorists, not Jewish residents of Yehuda and Shomron. The administrative orders were served just before the hearing at which the detainees were expected to be released, giving the impression that the orders constitute a violation of the basic rights of Yehuda and Shomron residents. Such violations must stop. As I have declared previously, I call on the legislature to eradicate such violations.”

Attorney Poleski added: “Minister Gallant’s conduct is outrageous. On the eve of Rosh HaShana, the State of Israel is sending a young married man and father of a small girl to detention behind bars for four months. No evidence against him was presented. At last week’s hearing, the judge extended his remand to allow time to complete the investigation that would refute the charges against him. After the GSS saw that there were no plans to put my client on trial, they insisted on a measure, administrative detention, that is inappropriate in democratic states. My client was administratively detained without being granted the opportunity to defend himself from the charges against him. The use of administrative orders to harass detainees must stop.”
