Hilltop detainees released

Tuesday, July 3, 2018, 14:07 A minor and an adult were detained overnight on Monday, July 2 at a hilltop adjacent to Itamar on suspicion of violating a closed military zone order. The detainees were taken for interrogation to the police station and refused to be released under restrictive conditions. Consequently, they were brought to the Petah Tikva Magistrate Court for a deliberation on Tuesday, July 3. The police demanded their release on condition of a order distancing them from a large area, including the Tapuah Junction, Yitzhar and other areas, and also demanded that the court require the detainees to sign on bail and a third party guarantee, and also to post a bond of 2,000 NIS each.
Honenu Attorney Chai Haber, who represented the detainees, pleaded during the deliberation that the court could not order in a legal decision to distance the detainees from a site for which in any event there is an order prohibiting them from entering.
At the end of the deliberation the court rejected the police demand and ordered the release of the detainees on condition only of signing on a personal guarantee, but stressed to them, in order to remove all doubt, that there is an order forbidding entry to the hilltop in effect until July 22, 2018.
Honenu Attorney Chai Haber stated in response that, “It is a shame that time after time the police choose to leave individuals in remand or bring them to court, demanding release conditions, when it is obvious to all of us that they could sign on a personal guarantee by an officer’s order and be released on site.”
