Monday, August 10, 2020, 12:03 On Monday, August 10, at 13:30, a deliberation is scheduled to take place at the Military Court in Yehuda on the Ofer Military Base on the appeal of the possible tightening of the penalty of the terrorist Ziad Awad, who murdered Police Commander Baruch Mizrahi, Hy”d, on April 14, 2014. Mizrahi and his family were traveling on Route 35 to Kiryat Arba to celebrate the Passover Seder there when Awad opened fire, killing Mizrahi and injuring others. Awad has been convicted and sentenced to life imprisonment. In the appeal, the Military Advocate General demands an increase in the sum of compensation that the terrorist is obligated to pay the family.
During the course of the deliberations Honenu Attorney Chayim Bleicher, who is representing Hadas Mizrahi, Baruch’s widow, and her family as victims of terror, submitted a calculation of damages totaling ten million NIS. Due to Coronavirus restrictions allowing only first-degree relatives to be present at military court deliberations, only Mizrahi, accompanied by Bleicher, will be present at the deliberation.
The Military Advocate General filed an additional appeal demanding an increase of the compensation that the terrorist who abetted Awad, his son, is obligated to pay. The appeal also concerns the possible tightening of the penalty imposed on the abettor, who was sentenced to only 20 years’ imprisonment.
Honenu Attorney Chayim Bleicher: “The terrorist [Ziad] was released in the Shalit Deal and received a second opportunity to carry out his murderous plots. Being as the current policy is not to hand down death sentences, despite a clear need to do so, we are demanding that at least the penalty be tightened in other ways, for example imposing a higher sum of compensation for the victims of terror who were awarded a low sum by the first court.”
