Sunday, December 8, 2019, 11:29 On the morning of Sunday, December 8, Petah Tikva Magistrates Court Judge Erez Melamed cancelled all of Neriya Zarog’s restrictive conditions following a request filed by Honenu Attorney Adi Keidar. Keidar filed the request to reexamine the case and cancel the conditions in light of the fact that Zarog’s administrative order has expired.
In his decision Judge Melamed mentioned that the fact that the administrative distancing order had not been renewed indicates that the danger Zarog was perceived to pose, which led to setting the restrictive release conditions, had been significantly reduced. Judge Melamed also noted that “not renewing the order constitutes a change in circumstances, which has the power to lead to a change in the release conditions. As long as the danger the petitioner posed was clear and present, there was a strong likelihood that the administrative order would be renewed. In conclusion, I order the cancellation of the restrictive release conditions of the respondent.”
Honenu Attorney Adi Keidar, who is representing Neriya Zarog: “We welcome the decision by the court to cancel the conditions, which were already impractical and had no purpose. And we are astounded by the position of the prosecution who adamantly opposed our request.”
On November 26, following a steadfast struggle against the administrative order, Neriya Zarog was released from remand. For over two weeks Zarog refused to sign on release conditions which obligated him to obey the administrative distancing order which removed him from his home, community and place of work. Only after the order expired did Neriya agree to be released to his home in the Kumi Ori neighborhood of Yitzhar.
