Honenu petitions High Court in Sde Teiman case

Monday, November 10, 2025, 16:54 Honenu is representing two of the five IDF Unit 100 soldiers indicted in the Sde Teiman case on suspicion of assaulting a Nukhba terrorist prisoner who took part in the Simhat Torah massacre (October 7). Although a gag order was imposed on the case, the Military Advocate General leaked a video clip, since proven to have been falsified to incriminate the soldiers, to the media. The Ministry of Justice appointed the Judiciary Ombudsman, retired Judge Asher Kula, to oversee the investigation of the leak. Due to interference by the Police Commissioner Dani Levi, Honenu petitioned the High Court of Justice to order Commissioner Levi, and the Deputy Attorney General, Gil Limon, to recognize the authority of Ombudsman Kula.

In the petition, Honenu demands that Ombudsman Kula be given all the investigative material of the case, including the material pertaining to the investigation of the former Chief Military Advocate, Yifat Tomer-Yerushalimi: “The Attorney General and the Deputy State Attorney were determined likely to have conflicts of interest in the investigation, and therefore be ineligible to handle the case. In light of the importance of investigating this case without the interference of individuals who have conflicts of interest and with the oversight of a neutral authority, the Justice Minister appointed the Judiciary Ombudsman to oversee the investigation. The Police Commissioner has refused to cooperate, even after the honorable court decided that an interim order would not be given with regard to the appointment of the Ombudsman, meaning that his appointment is currently not under any legal restrictions. The Police Commissioner decided to issue an ‘interim order,’ without any authority and contrary to the law.”

Honenu issued a statement: “Although the court did not issue an interim order prohibiting Ombudsman Kula from overseeing the investigation, the Police Commissioner consciously chose to prevent him from fulfilling his duties. The Police Commissioner is undermining one of the most serious investigations in the history of the State of Israel, and preventing the investigation from arriving at the truth. We hope that the court will order the Commissioner to transfer all of the investigative material to Ombudsman Kula immediately.”
