Ben Uliel was indicted on the basis of a confession and a reenactment that were extracted from him under torture. Both the GSS and the Attorney General’s office knew that that the descriptions written in the bill of indictment were false. They did not match either the findings at the scene or the eyewitness testimonies.
It is obvious that one person did not carry out the arson attack in Kfar Duma, but nonetheless, the indictment states that Ben Uliel alone torched the houses and wrote two sets of graffiti, in two styles of handwriting. If the Attorney General’s office had not lied, there would not have been an indictment. Ben Uliel’s fabricated confession would have been invalidated out of hand.
A matter of days after Ben Uliel was indicted, Ma’ariv published an article titled “The GSS admits that the murder in Duma has not been fully solved”. That did not stop the Attorney General’s office from moving full speed ahead to convict a man who appeared to be innocent.
Three years later, in an interview on the Israeli Uvda investigative and current affairs program, Chief Superintendent Erez Amouyal, who led the police investigation team in the Kfar Duma case, half-heartedly admitted that “we didn’t succeed,” when he said that although the indictment states that Ben Uliel acted alone, he as head of the investigative team does not believe that one person carried out the arson attack. Amouyal believed the eyewitnesses, not the version of events written in the bill of indictment.
