Military Court: Barkan terrorist’s father detained until end of proceedings

Thursday, November 29, 2018, 18:58 On Thursday, November 29, the Military Court in Yehuda ordered the remand until the end of proceedings of the father of the terrorist who carried out the October 7 attack in Barkan in which Ziv Hajbi and Kim Levengrond-Yehezkel were murdered. An indictment has been filed against the father for the crime of failure to prevent an attack and attempted obstruction of the investigation after the attack.
The current decision follows the court’s decision the previous week to detain the terrorist’s brother until the end of proceedings and to extend the remand of his mother until March, at which time the court will rule again on the possible extension of her remand. The terrorist, Ashraf Na’alwa, has not yet been apprehended and the search for him continues.
Honenu is assisting the Hajbi and Levengrond-Yehezkel families as victims of terror with the legal proceedings in the military court. Honenu Attorney Chayim Bleicher: “The indictment indicates that the terrorist’s entire family had a hand in the attack, and that they could have prevented the attack by turning the terrorist in to the IDF. Only unequivocal measures such as complete and immediate demolition of the terrorist’s house and expulsion of the terrorist’s family will prevent the next attack.
“The hesitation of the IDF [to take action] and the partial demolition of terrorists’ houses, in addition to the exhausting deliberations in the Supreme Court, wear away the deterrence factor and reduce its effectiveness. As we see in the indictment, the father of the terrorist was concerned that the house would be demolished and initially tried to convince his son to desist. However he was not concerned enough to turn him in.”
Bleicher added that, “There is no doubt that effective, concrete, decisive and immediate deterrence measures would have caused the terrorist’s father to take active steps to stop the attack. The situation was the same in the case of the terrorist who murdered three members of the Salomon family in Halamish.
“We call on the security system and the Supreme Court Justices to reexamine their decisions and to order the complete demolition of the terrorist’s house, without any further delay.”
