Military Court exonerated terrorist who shot Ben-Yosef Livnat, Hy”d

Monday, September 13, 2021, 16:56 A panel of judges headed by the President of the Military Court of Appeals, Judge Colonel Netanel Benisho, exonerated Noaf Fahd Nawaf  Benni Uda from murder and left standing the conviction handed down by the Shomron Military Court. Noaf is one of the terrorists who shot at Ben-Yosef Livnat, Hy”d, at Kever Yosef (the Joseph’s Tomb compound) in Shechem. The decision was reached in the framework of an appeal filed by the Military Advocate General against the decision by the Shomron Military Court which exonerated Noaf from murder, convicted him only of opening fire on a person and disrupting judicial proceedings, and sentenced him to only six years’ imprisonment for his involvement with the murder.

Noaf, a Palestinian Policeman, who was released from prison after serving his sentence and has been promoted in the Palestinian security system, was charged, along with two other Palestinian Policemen, with opening fire from a distance of seven meters on Jewish worshipers at Kever Yosef (the Joseph’s Tomb compound) in Shechem on April 24, 2011. Ben-Yosef Livnat, Hy”d, was shot in the neck and died of the injury. After the shooting, the shooters scattered rocks at the scene with the intent of tampering with the evidence at the site.

Honenu Attorney Chayim Bleicher, who is assisting the Livnat family: “Today, the terrorist who murdered Ben-Yosef Livnat, Hy”d, was released to freedom. The Military Court of Appeals accepted the scandalous ruling handed down by the first court, which exonerated the terrorist from murder, even though everyone said that he is a murderous terrorist. There is no other possibility, as the court said now, there is no other theory to explain how he was murdered other than by the bullet that the terrorist shot in his direction.

“This was an attack on the People of Israel, it was a huge disgrace. Unfortunately the military courts are busy with specious, pedantic legal arguments, and are not capable of giving a simple response to a terrorist who clearly murdered a Jew.”

After the hearing, Rivka Livnat, Ben-Yosef’s mother stated that “the weak system that gave weapons to the Arabs of Shechem, is the same one that released my son’s murderer. Nobody doubts that he is the murderer, but nevertheless they released him. I don’t want other families to be here, with the same terrorist, in the same situation, but that is what is happening. And if that didn’t happen, then every terrorist would see what could be done [stringent sentences for terrorists], but look, they [the terrorists] are walking free.”
