Court rejected appeal filed by police, partially accepted Honenu’s appeal

Sunday, December 18, 2011, 16:03 A short time ago the Jerusalem District Court released two of the detainees detained last week in the administrative exiles’ apartment. The two were released by the Jerusalem Magistrate Court on Friday, however the police appealed the decision and therefore they remained in remand.
District Court Judge Moshe Yo’ed HaCohen rejected a short time ago the appeal filed by the police demanding a remand extension for the two detainees detained last week in the administrative exiles’ apartment. The judge partially accepted the appeal filed by Honenu attorney Naftali Wertzberger and ruled that the two will be released to house arrest outside of the Yehuda and Shomron region for a week, after which time they will be under a restraining order banning them from entering Yehuda, Shomron and Jerusalem for an additional week.
Judge HaCohen wrote in his decision that, “It should be noted that the evidence does not link by name any of the respondents to a specific crime.” The judge also leveled veiled criticism at the Magistrate Court, which according to him did not justify the cause for the restraining order banning entry to Jerusalem, Yehuda and Shomron for a lengthy period of time.
At the end of the deliberation the judge shortened the period of the restraining order, but conditioned the release of the detainees on a 3,000 NIS bond.
In a related step, the appeal filed by Honenu on the other detainees was rejected by the court.
